Rapid Turnaround Times – Guaranteed
1.1. Ownit Conveyancing Australia Pty Ltd hereinafter referred to as "Ownit," is committed to providing efficient and rapid communication throughout the conveyancing process to ensure the smooth execution of your settlement. We guarantee that all communication received by Ownit will be acknowledged and responded to within 3 business hours during regular business days, being 8:30am to 5:00pm, Monday to Friday excluding public holidays and any additional times that our office is closed. This commitment demonstrates our dedication to treating your inquiries and concerns as a priority.
1.2. For the purposes of this Guarantee, phone calls and email communication between the client and Ownit constitute the scope of communication covered.
1.3. An attempt to contact you, which results in a message being left by Ownit, shall constitute a response within the guaranteed time frame. Ownit will make reasonable efforts to reach the client by phone, but it is acknowledged that it is out of Ownit's control whether the client accepts an inbound call from Ownit. In the event that the client's phone does not have voicemail capability or the voicemail box is full and cannot accept messages, Ownit will send an email acknowledgment of the attempted communication to the client's provided email address and this shall also constitute a response within the guaranteed time frame.
1.4. It is important to note that meeting the guaranteed response time for phone calls and email communication does not necessarily imply that the query will be fully resolved within this timeframe. There are various factors beyond Ownit's control that may affect the overall resolution time, especially when waiting for matter resolution involving third parties. However, Ownit commits to responding to any inbound email or phone call within the service turnaround time guarantee as specified. Non-resolution of an action does not constitute a breach of the guarantee.
2. Terms and Conditions
2.1. The 10% reduction applies exclusively to Ownit's professional fee associated with the standard conveyancing service.
2.2. The guaranteed response time of 3 business hours applies to communication received during Ownit's regular business hours as specified in our standard operating hours.
2.3. To qualify for the reduction, clients must submit a written request to Ownit within 7 business days of the communication that did not receive a response within the guaranteed timeframe and provide evidence of same. Any claim presented to Ownit outside of 7 days will result in no eligibility.
3. Sole Discretion of Determining Standard or Non-Standard Matters
3.1. At all times, Ownit holds the sole and final discretion to determine whether a matter has been deemed standard or non-standard under the terms of this Guarantee. Ownit's determination in this regard shall be binding, and clients acknowledge and agree to accept Ownit's decision without dispute.
By engaging our conveyancing services, you expressly acknowledge and agree to the sole discretion exercised by Ownit in classifying matters as standard or non-standard.
4. Effective Date
4.1. These terms and conditions, inclusive of the previous terms and the Sole Discretion paragraph, are effective as of 1 September 2023 and supersede all prior agreements or guarantees, whether written or oral, related to the rapid communication commitment provided by Ownit.
Guarantee of No Hidden Fees
1. No Hidden Fees Guarantee
1.1. We, Ownit Conveyancing Australia Pty Ltd, are committed to providing you with a transparent and straightforward pricing structure for our standard conveyancing service. We guarantee that you will not incur any hidden fees during the course of our service, even in the event that negotiations are required for building and pest matters.
1.2. Our standard conveyancing service is defined as the utilisation of an REIQ (Real Estate Institute of Queensland) Contract that adheres to all the timeframes specified in the originally signed Contract, provided that it stipulates a minimum of 30 days from Contract Date for Settlement Date. Any deviation from the standard REIQ Contract, including situations where settlement does not occur as scheduled or under 30 days from Contract Date, will be considered non-standard and may result in additional fees.
2. Standard Conveyancing Services
2.1. Our standard conveyancing services include, but are not limited to, the following:
a) Reviewing the Contract in the standard REIQ House and Land approved form;
b) Providing a brief summary of critical dates within the Contract;
c) Preparing transfer documentation as necessary;
d) Collaborating with you to ensure finance approval is obtained, if applicable;
e) Conducting relevant property searches;
f) Liaising with your financial institution to arrange settlement;
g) Calculating settlement figures in accordance with the Contract terms;
h) Communicating and coordinating with the Seller's Solicitors to facilitate settlement;
i) Calculating, collecting and paying Stamp Duty to the Treasury.
j) Facilitating settlement in the Property Exchange Australia (PEXA) platform.
Our quoted fees only cover the things we have specifically stated above as being included. All other costs and outlays are additional.
3. Additional Fees and Non-Standard Situations
3.1. While we are committed to our No Hidden Fees Guarantee, it is important to note that certain situations may arise during the conveyancing process that are beyond the scope of our standard services. These non-standard situations may include, but are not limited to, protracted negotiations, unforeseen difficulties, changes in particulars on the Contract or unanticipated expenses related to the conveyancing process.
3.2. In the event that your matter becomes non-standard or if unforeseen circumstances or additional expenses arise, we will promptly notify you of these developments to ensure that nothing is hidden as transparency is key. At this stage, additional fees may be necessary to cover the protracted scope or expenses incurred.
4. Client's Acknowledgment
4.1 At all times, Ownit Conveyancing Australia Pty Ltd holds the sole and final discretion to determine whether a matter has been deemed standard or non-standard under the terms of this Guarantee. Ownit's determination in this regard shall be binding and clients acknowledge and agree to accept Ownit's decision without dispute.
By engaging our conveyancing services, you expressly acknowledge and agree to the sole discretion exercised by Ownit in classifying matters as standard or non-standard.
5. Effective Date
